Terms of service

These terms govern your use of pekkish. By signing up or placing an order through a pekkish-powered storefront, you agree to them. They apply to operators (businesses using Pekkish to take orders) and customers (people placing orders).
1. What Pekkish is
Pekkish is a service operated by One Tandem Limited, a company registered in England and Wales, trading as Pekkish ("we", "us"). It is a technical service that lets food businesses (operators) take online orders. We provide the storefront, ordering flow, payment integration, notifications, and admin tools. We are not the seller of any food or drink — every order is a contract directly between the customer and the operator.
2. Operator terms
2.1 Eligibility
You must be a registered business or sole trader operating legally in the United Kingdom. You're responsible for ensuring your menu, prices, and operations comply with all applicable laws — food safety, allergens (Natasha's Law), VAT, consumer rights, and so on.
2.2 Payments and fees
You connect your own Stripe account via Stripe Connect. Customer payments are deposited into your Stripe account directly. Pekkish takes:
- A monthly subscription fee (£0 Free, £19 Pro) charged at the end of each month
- A platform fee on each order — 3.5% on Free, 2.5% on Pro — billed at month end via Stripe
The platform fee is calculated on net GMV — your gross sales less any refunds you issue in the same period. If refunds in a period exceed sales, the fee is floored at £0; we don't pay you back, but we don't bill you either.
Stripe's own processing fees are charged separately by Stripe to your account.
2.3 Your obligations
- Fulfil orders accurately and on time, or refund the customer
- Provide accurate allergen information for every menu item
- Keep your account credentials secure
- Not use Pekkish to sell anything illegal, unsafe, or in breach of consumer law
- Comply with your obligations as a data controller for customer data you receive through Pekkish
2.4 Suspension and termination
We may suspend or close your account if you breach these terms, fail to pay, or use Pekkish in a way that risks harm to customers or the platform. You can close your account at any time from your billing settings; outstanding fees remain payable.
3. Customer terms
3.1 Your order is with the operator
When you place an order on a Pekkish-powered storefront, you're entering a contract with that operator — not with Pekkish. The operator is responsible for fulfilling your order, handling allergens, processing refunds, and resolving disputes.
3.2 Payment
Payments are processed by Stripe and go directly to the operator. Pekkish does not hold customer funds. Refunds, when applicable, are processed by the operator through Stripe.
3.3 Account use
You agree to provide accurate information, keep your login secure, and not use the platform for fraud or abuse.
4. Service availability
We aim to keep Pekkish running reliably but don't offer a formal service-level agreement at this stage. The service is provided "as is." We'll communicate about planned maintenance and significant outages where we can.
5. Intellectual property
The Pekkish brand, software, and platform belong to us. Operators retain ownership of their own menu content, branding, logos, and customer data. By uploading content to Pekkish, you grant us a licence to host and display it as needed to run the service.
6. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that can't be limited under English law.
Subject to that, our total liability to you in any 12-month period is limited to the fees you've paid to Pekkish in that period (or £100, whichever is greater). We're not liable for indirect or consequential losses, lost profits, or third-party claims.
Pekkish is not liable for the quality, safety, or fitness of any food or drink ordered through the platform — that's a matter between the customer and the operator.
7. Changes to these terms
We may update these terms from time to time. Material changes will be notified to operators by email at least 14 days before they take effect. Continued use of the service after that constitutes acceptance.
8. Governing law
These terms are governed by the law of England and Wales. Disputes that can't be resolved between us are subject to the exclusive jurisdiction of the English courts.
